Situation... Two #12 wires connected to one 40 amp breaker. I call it out on the report as two wires on a single over sized breaker recommend replacing with two 20 amp breakers by a licensed electrician.

Listing agent calls me this morning.... "#12 wire is for 20 amps, I looked it up this morning. 20 amp and 20 amp is 40 so the one breaker is good. duh! Can't you even do math? How dumb are you? I need you to take it off the report and resend the report the buyer so they will stop asking for the repair"

Yeaaa... that's going to happen. I didn't even bother explaining. URG

KR: I don't know, but standing up with a fish in front of you and smiling like you had good sense is not a good sign.:D

Sure they can use it! Tell them to get a hacksaw and cut it in 1/2!

A conductor cannot be connected in paralell unless it is 1/0 or larger. See 2005 NEC 310.4.

Also, the only way these would be in parallel would be if they both went to the same thing, and that is highly unlikely.

Plus, there are other requirements for parallel conductors other than just that minimum size of 1/0. :)
