Can't deny, it is a fireplace. It could set the place on fire, but that would be the inspector's fault, eh?:(

Do not think setting place on fire would happen before house would fill with smoke or smell.
But would be HI fault for not catching problem. But min SOP would have caught it????
Of course Listing Agent would not be at fault??? Or Seller at fault for non disclosure???

Man you guys are picky. It's a fireplace. It's got a chimney. No the chimney doesn't go outside, but the fireplace is pretty.:D

The listing agents argument would be that it is listed with a fireplace, but that there is no mention of a full chimney.

By George, I think I have it.
The fireplace listed is part of food smoker system.
Hang your meat in the attic and you can keep the fire going in the comfort of the living room.
No more going outside to tend the smoker.
