Is this considered flex pipe or an approved installation. House built in 1999.

That gray piece is rigid. I believe its polyethylene, not PVC, and they come with most faucets.

The very upper section did not appear to be rigid

Well, I've seen those dull, gray tail pieces many times. Very rigid.
