Mechanical exhuast vent

I was in a condo and the mechanical exhaust vent from the lower unit was present in the upper units master bedroom closet and vented through the ceiling. The HOA of the condos said that all units are like that. I marked it as deficient and suggested that the people buying the upper unit reroute the vent. I was wondering if anyone has experienced this and give me additional suggestions in what i can inform my client with. Thanks in advance.

But the vent should not be exposed and there should be some sort of fire separation from the lower units vent.
