This is the secondary egress from a below grade living space in a bi-level condo. Even if you can climb that ladder, you're fenced in at the top. No gate.

But... can the ladder really be that high? I'm not seeing anything in the IRC limiting the height.

No only is the ladder allowed to be that high, it is required to be to the top of the fence or have a gate there, and, if to the top of the fence, then there would need to be some type of platform installed with a railing around it because it would be greater than 30" above the ground below - so, yes, it needs a gate in that fence at the top of the ladder.
