So the chimney is to be 3 ft from which deck?

2 ft above any part of the roof within 10'.
Looks ok from my front porch.

Must be at least 3 feet high above the high side of the roof it is through - not sure it makes that.

Then at least 2 feet higher than ANY part of ANY structure within 10 feet - looks like it makes that. :)

Yes, this AND that.
Looks to be a bit of a challenge to confirm because of the type of roof materials.
Pity the chimney sweep that has to inspect and clean.

In this case, it may be acceptable. Rather than stating up front it is a problem then back-pedalling, why not state that it appears suspicious but without the listed instructions, you can not state whether it is acceptable or not. Therefore, recommend a qualified hearth appliance technician inspect it with the listed instructions.

Generally speaking, isnt this on 12" required above, and 1" to the front and sides. If so, this one looks ok.

Here is a good one I found today. Used to be a corner fireplace open at the front and the end. Someone got the bright idea to build a wall to cover the end and it extends around the front too close to the opening as well.
