That inspector has probably passed away from sweating bullets.

Probably because of the previous lawsuit between the seller and the builder, which they dismissed after the contract and sale to the buyer.

1) That means the seller absolutely knew about it (it was their lawsuit against the builder).

2) The agent almost assuredly knew about it (how could they not know about it with their dealings with the seller).

3) The home inspector was not privy to the lawsuit and probably did not know about it, thereby relieving the home inspector from that knowledge, which, I am guessing, was the basis for the lawsuit (buyer probably found out about it during their investigation into the water leaks and who knew what when).

Just my guesses, that's all, no other knowledge about it than the article.

I read another account of this and the people that left the note were the previous home owners that lost the home through foreclosure due to the mold related expenses. They had nothing to lose by leaving the note for the new owners. They left it in a hidden location in hopes the bank and cleaning crews would not find and destroy the evidence.

I know some of the parties to the Corpus article. Don't know who the inspector was. I was told he was not included because he "did not have any money".
I'm trying to get a copy of the transcript - curiousity. There is lots of stuff floating around about this - not many facts.

The court clerk does not yet list this case as disposed as of 16 November. Final documents have not been filed. It will be interesting to see how this one finally works out.
