The house is on a hill side. The garage is in the basement. The radon pump in the garage. The outlet of the radon discharge is on the back side of the house, 18 inches above the ground, 24 inches below and 40 inches left of a window sill.

Maybe they used the right size and type of pipe? That would probably be the ONLY thing they did right.

It wouldn't meet the EPA guidelines and unless your state or local municipality have required installation standards there isn't much that can be done about it.

I had a similar case here in MN a couple years ago where the mitigation system discharged at the kitchen window. Because the EPA guidelines aren't enforceable and mitigation installation requirements aren't covered by building codes here the seller couldn't be forced to fix it. Buyers walked though.

Radon is covered in IRC in Appendix F. In my area, builders are required to rough-in a mitigation pipe and cap it in the attic. Some take it thru the roof, some don't.
