What says it cannot be mounted that way?

Nothing. HOWEVER ... I would (and have) write it up as unsafe for the person who has to work on it. I ask my client 'Would you want to find your a/c technician or electrician laying on the ground beneath that, dead? The looks on their faces are priceless - they understand quite readily.

By the way, that's a dryer vent cap, not a wall flashing, that the refrigerant lines are coming out of.

And the service side of that condenser unit looks like it is facing the wall, and it is required to have at least 36" clearance in front of the service access area.

Now THAT is a problem, the maximum slope for a tread is 1/4" per foot, cross slope or in the direction of travel.

"Assumption": The stair width is 3 feet. 3 feet times 1/4" per foot equals 3/4" maximum tread slope for a 3 foot wide stairway.

That stair (with the "assumption" that it is 3 feet wide) slopes 2/3" per foot, that's .667 inch per foot, which is almost 11/16" per foot slope.

The key is you said (and the photo shows) "next to".

If, however, that was "under" or "below" the operable window, *and*, that is an EERO, then it would be a problem as it would interfere with escape and rescue. If it was under an operable window which was not an EERO, then it would just be *stupid*. :)
