If I'm not mistaken... doesn't this defeat the whole purpose of an air gap?

I don't see an air gap, but I see a dishwasher discharge line the is not trapped emptying into a waste water line. Needs to be trapped.

*MIGHT HAVE* (although unlikely it may be) a "high loop", in which case the air gap is not required (unless you are in a state which still requires it - most, if not all, have now accepted the "high loop" in lieu of the air gap.
Even connecting to a garbage disposer or a tailpiece, all that provides is a "air break", which is not the same as an "air gap".
Yes, the that needs to connect in before the trap, not after it.
What they really need to do is to re-configure that design so that one goes down, enters the tee vertically from the top, the other then enters the tee from the horizontal at the center tee, with the bottom of the tee connecting to the trap.

Additionally the dishwasher manufacturers are all over the map on their requirements if you are not using an air gap device. Either 18" above the floor or 20" above the floor for the connection . . .

Your first link shows 32", not 18". ;)
The second one shows your 20", but not to the top of the high loop. ;)
The second one also shows an "S" trap. :eek:

So Jerry, no there was no high loop... question though, even if there had been shouldn't this still be trapped? Thanks for the great links...

Not that you saw ... some dishwashers have a 'high loop' affixed to the side of the dishwasher by the manufacturer. One would either need the installation instructions or to pull the dishwasher out to find out.
