Moot point, access to the lower one is a little limited. That said I would rather fall with the top one than have the top one fall on me.

Since super powers are apparently needed to use the lower one, I'd say it's safer.

Now that is simple. The builder did not think the lower safe enough so he did not put a door to it. If the builder doesn't think it is safe then I certainly would not :)

I betch if a kid falls while attempting to climb up or down to the lower balcony some attorney is going to use "attractive nuisance" as a basis for the lawsuit.

I would think the builder did it for no other reason than cosmetics. Consistency in appearance.
