I believe this one falls under the 1"(and common sense) to combustibles rule. I am posting it to be sure there is no rule that allows this. An ordinary composition boot is used for the flashing for the water heater flue. I also noted the missing cap. The furnace flue was a different issue.

No exception allowing this, 1" clearance to combustibles would specifically prohibit plus the need to use the listed flashing component with the b-vent.
Don't forget the height of the flue above the roof.
