    If the "exposed area" (IRC language) of that bottom pane is 35 inches wide and it is square, then it isn't greater than 9 square feet and so wouldn't have to be safety glazed.

    and to expand on Jonh's information the window pictured is not an equally sized upper and lower sash therefore the lower sash would be less than 35" tall/high. Non-tempered OK by code but a simple advisement to your client should not be questionable.
