Looks like a hazard to foot traffic to me. If you're coming up the stair you would have to back-down a step or 2 to open the gate and if you have small kids you don't want the gate opening over a stair.
I don't care if it's a door or a gate, a safety hazard is a safety hazard.and you should call your client's attention to it and recommend correction.
