When did it go into effect about the 36" from the top or bottom step. I did a home today that was 4 years old and the windows at the top and bottom were approximatly 1 foot from the top step and bottom step and were about 36" high off the plane.

You are talking about an obvious hazard to occupants. It makes absolutely no difference when or if a code addressed this as hazards don't predate anything except the injury (or death) that they may incur.
