Default Electric Panel - Ground Wire location

This panel has two ground wire entries.

The one on the bottom is the service panel ground and goes to the ground rod. The top one is routed to what I think is the swimming pool & equipment.

The top one looks too darn close to the main service breaker and appears to be a potential ground fault situation if nudged in the wrong direction.

Do you all agree this is a problem?
What is the code reference to this issue?

    Thanks!
    Ken
