Looks like a nice deck to me to sit and pull a splinter from your foot. I say enjoy the shade and cook a nice slab of ribs out there.

Would you want to know if you were buying the house?

I'd also tell them that those trees are going to grow and take out that small deck. And I'd mention that the posts are touching the grade and the deck frame; and that the deck frame then contacts the house. That's conducive to wood destroying insects. It looks like part of the perimeter joist is also touching the grade. As well, the grade next to the house is flat instead of being sloped 6" in 10' away from the foundation.

Would I make it sound like the most important thing that could happen at a house? Probably not. If you tell them, they will know and will probably just enjoy the deck until it becomes a priority for them. If you don't tell them, they'll curse your name every time they stub their little tootsies.
