Is that a chimney vent termination for a gas fireplace?
If so, there is no storm collar, and the decorative shroud is not allowed unless listed for that use (Bob H. taught us that, I often wondered about it before that).

Jerry,
It is for a wood fireplace and there is a flue next to it for a gas fireplace.

The one in the photo is not for the wood fireplace is it?

It looks like the outer pipe is too short and the storm collar won't fit the smaller inner pipe so they used tape and painted over it.
No matter, it is wrong and needs to be fixed.
Probably the only thing saving it from leaking like a sieve is the outer cover which, as Jerry mentioned, may not be allowed.

Jerry, It is for a wood fire place, you can see the soot on the arestor.
