Talking Fire place as a heat source

Does anyone know what the distance from a fireplace a thermostat should be. The condo today has a thermostat going to the fireplace as the only heat source for the living room and kitchen. I have told them before that the fireplace has to have a blower or fan in order to be considered a heat source for the room. The thermostat is in a poor location, it was 1' from the window and 3' from the fireplace. What do ya think

T'stats should be 5 Ft. above floors, away from wide temp. swings such as fireplaces, windows, TV sets, door entrances, etc. and should not be located on exterior walls.

Keep the fire in the fireplace.

Thanks. I have had problems with this builder before doing this in all units
