Default Gas Vent to Window Clearance

Am I not mistaken in that there should be 10' of clearance between this gas vent (servicing a Versa indoor pool heater) and the 2nd floor bedroom window and or be at least 3' above the eave of the 2nd floor roof surface? I measured 6' from the window (while I was inside the bedroom)...

FYI (as I know it would probably get commented to otherwise), the gas vent you see on the lowest roof surface (pool room) that is next to the screen porch had been discontinued and was not being used.

I believe most have a horizontal clearance spacing requirement of 5 feet to any building opening, and that 5 feet horizontal would be vertically all the way up.
