Default Would you write this up ? See photo

Condenser disconnect in sight of unit, but behind fence (and no gate). You can just see the top of the disconnect on the other side of the fence.

Same here, write it up.... in 'marginal' cases like a bush partially obscuring it you don't have to beat it to death. just state the facts - disconnect boxes are intended to have a clear line of sight for the safety of the people servicing the equipment and this one does not and should. Nobody can argue with the facts when they're presented in an unbiased way.

just out of curiosity: what would you guys say if there was a gate in the fence right there? (you can't see the disconnect, but it's right there.)

Disconnect is supposed to be "in sight". Even if there is a gate for 'easier' access it is still not "in sight".

Only for use for those with more than bordinghouse reach.
Not even if you had a gate, it needs to be within reach of
    the unit to the disconnect.
    Call it out.

    Terry,

You will need to explain that to me ...

"it needs to be within reach of the unit to the disconnect"

You did/do you get that from?
