That was done on purpose with great forethought and intentions ... they were just trying to keep the heat away from that paper facing on the insulation.

Rick yes you can use it as like Jack you give me credit. Thanks.
Bad install, original equipment, called for inspection prior to close of title. The unit would not fire up either, power vent would run but unit would not ignite.

If the unit would not ignite, then there is no hazard from the flue construction, nothing to write up.
