*IF* the bottom of the light globes are over 8' above the top of the tub, that installation is okay (presumably, thereby putting the ceiling fan 'out-of-reach').

Looks like an 8' ceiling from the photo, so I'd say the bottom of the globes are only about 5' above the top of the tub ... if that high.

Oh Gladys, while your taking a soak I'll take a nice hot shower!

That references the 8 feet height above the tub I mentioned in my post above - the NEC section is:

This zone is all encompassing and includes the space directly over the tub or shower stall.
