Honey, your hot bath is awaiting you
The tub is almost full and ready for you dear.
You need to turn off the light on the fan and get you some peace and quiet.
I'm going out to clean out that garage your been complaining about.

*IF* the bottom of the light globes are over 8' above the top of the tub, that installation is okay (presumably, thereby putting the ceiling fan 'out-of-reach').
Looks like an 8' ceiling from the photo, so I'd say the bottom of the globes are only about 5' above the top of the tub ... if that high.

You mean 2006 *IRC* E3903.10, right?
That references the 8 feet height above the tub I mentioned in my post above - the NEC section is:
2008 NEC
- 410.10 Luminaires in Specific Locations.
- - (D) Bathtub and Shower Areas. No parts of cord-connected luminaires, chain-, cable-, or cord-suspended luminaires, lighting track, pendants, or ceiling-suspended (paddle) fans shall be located within a zone measured 900 mm (3 ft) horizontally and 2.5 m (8 ft) vertically from the top of the bathtub rim or shower stall threshold. This zone is all encompassing and includes the space directly over the tub or shower stall. Luminaires located within the actual outside dimension of the bathtub or shower to a height of 2.5 m (8 ft) vertically from the top of the bathtub rim or shower threshold shall be marked for damp locations, or marked for wet locations where subject to shower spray
