Vent through attic

Odd installation. This image is taken from the attic, first floor. The vent is about 10" from the top of the box where it enteres the roof deck, where a firestop is installed. IMO, this should be an enclosed chase or a firestop should be in place at this ceiling height.
What say you?

Chase is not needed or required.

... or a firestop should be in place at this ceiling height.

The vent is required to be fireblocked at the ceiling and floor levels, whether or not it was in a chase.

R1003.19 Chimney fireblocking

All spaces between chimneys and floors and ceilings through which chimneys pass shall be fireblocked with noncombustible material securely fastened in place.

I was suggesting the chase because it's blocked at the roof which is approx 10' from the top of the box. If the vent was fireblocked I.E. chase, the metal stop at the roof would meet the minimum standard. Yes?

R1003 is for masonry chimneys. This is a factory built chimney. R602.8 and thus R302.11 are your reference under the 2009 IRC. Before this, wasn't Calif under the UMC, which called for vertical fireblocking?

That's the case in my Jurisdiction, until next month then they go IRC.
I hate questioning my knowledge but when you see somethig like this house in a house that was just built and issued a COO, you start to wonder... so I was just questioning how come this was considered acceptable by the AHJ actually.
