Default Wut's up with this vent?

So this vent is from a water heater, viewed from the second story. It terminates 5 feet from this operable window and less than that from that wall to the right. From what I understood, the vent must terminate above the roof when less than 8 feet from the wall (I thought it was 5'), and then there is this window.

    G2427.6.3 (503.6.4) Gas vent termination.
    A gas vent
shall terminate in accordance with one of the following:
    1. Gas vents that are 12 inches (305 mm) or less in size
and located not less than 8 feet (2438 mm) from a vertical
wall or similar obstruction shall terminate above
the roof in accordance with Figure G2427.6.3.

Correct-- it can't be within 8' of the sidewall. When it gets extended, it must extend up a min. of 2' above the upper roof line as well.

I believe you are not reading the correct code

    2. Gas vents that are over 12 inches (305 mm) in size or
are located less than 8 feet (2438 mm) from a vertical
wall or similar obstruction shall terminate not less
than 2 feet (610 mm) above the highest point where
they pass through the roof and not less than 2 feet (610
mm) above any portion of a building within 10 feet
    (3048 mm) horizontally

Over, under 12"...Isn't the vertical wall issue still applicable?
    Thanks

Brandon, Obviously it can be w/i 8' because someone did it. But I know what you meant.

    There is a difference

Gas vents that are 12 inches (305 mm) or less in size
and located not less than 8 feet (2438 mm) from a vertical
wall or similar obstruction shall terminate above
the roof in accordance with Figure G2427.6.3.

The photo shows it IS LESS than 8'
Since it IS LESS than 8', then rule 2 applies

    (3048 mm) horizontally

ooh yes, I had to read that twice and slowly. I hate the way code is written.
