Thanks for all of the information. After reviewing most of it I have decided that the answer is Yes and No. Depending on where you are and who you ask.

Yep, pretty much sums it up. I make a note of it and refer them to the local building department for clarification.

The lower element should be 18" off the floor from what I know.
