Default Gas water heater connected to a oil fired boiler vent pipe

Is there a code violation if a gas fired water heater vent pipe connects into a oil fired boiler vent pipe which then connect into the sealed chimney vent?

IRC 2427.5.6.2 allows it. If the gas utilization equipment is automatically controlled it's required to have a safety shutoff device. Your local codes may restrict it though.
