As this is an Electrical Appliance location isn't an issue.
It does need a flow pipe with a 2" air gap for the TPR valve.
Needs a catch pan and drain installed.
Receptacle needs a cover installed.

Water heater appears to be amateur installation. Among the deficiencies are lack of TPR valve extension, unprotected Romex-type wiring, lack of proper wire clamp. Recommend full review of water heater system and repair as needed by licensed plumbing/electrical contractor.

That's just asking for the same plumber who installed that joke to come back in and bless his installation.
Instead, say it this way:
First, list everything you see wrong, then ' "repair as needed by licensed plumbing/electrical contractor" including but not limited to all above noted items and any other items found or created during those repairs'.
